Preservation order

Compliance, by its very nature, can only go one way, but some companies still falsely believe that they can demonstrate after the fact. Rich Turner, Vice President of Business Development and Strategic Marketing for C2C Systems, examines why there is no such thing as 'retrospective compliance' and what UK companies can do to effectively demonstrate compliance from the outset

Comment

The biggest news in the industry as this edition of our newsletter is being finalised is the proposed acquisition of Kofax by Lexmark. The Kentucky company has been unrelenting in its swallowing up of smaller (and occasionally not so small!) rivals over recent years, but this one - although widely rumoured for some time - is still something of a shock to many. While several commentators said on the appointment of Reynolds Bish as CEO of Kofax that it would be merely a matter of time before the company made itself available for acquisition, the manner and speed of this deal (from the outside at least) is still a surprise.

Perhaps as many questions are now being asked about the future of the new merged business itself, as are being asked about the impact on the wider sector. Is there really room in the Lexmark portfolio for so many products that, to the casual observer, seem to sit in very similar or overlapping spaces: Brainware, ReadSoft, Perceptive and now Kofax with its own range of in-house and acquired technologies could make for a slightly bewildering range of offerings. Doubtless the next year or two will see the new business undergoing significant rationalisation as 'similar but different' offerings are integrated: Lexmark can only hope that the rest of the market - and their enlarged customer base - is happy to sit and wait while that happens. We live in interesting times!
